Plaintiff's Claim: On 12/27/98 services were provided by All-Care Animal Referral Center Inc. To date all or a portion of these services remain unpaid.

Defendant's Position: Gloria Cutter's dog "Rufus" had shown increasing weakness and excessive thirst. His condition worsened and late one night, she took him to All Care Animal Referral Center for evaluation. They could find nothing wrong with him and released him at approximately 2:00 am. By 8:00 am the next morning, Ms. Cutter returned with "Rufus". All Care told her they would perform tests that would run approximately $600. One week later, they contacted Ms. Cutter and told her she could come and get "Rufus". They could not identify anything wrong with him. The bill was now approximately $3,000.

In an effort to find out why "Rufus" continued to worsen, Ms. Cutter took him to another veterinarian which described "Rufus'" condition as kidney failure. This veterinarian also told Ms. Cutter that "Rufus" should have never been treated in the manner he was at All-Care. A simple urinalysis could have easily identified the problem.

Resolve:
Judgment for the Defendant.
