Summary of Case:
July 20 and 21st, 1998 at the animal treatment facility, located at 18440
Amistad Street, in the city of Fountain Valley, County of Orange, State of
California.
At said time and place, the plaintiff brought to the defendants, and each of
them, her dog for care and treatment. For consideration, the defendants, and
each of them, undertook to render care and treatment to the plaintiff's dog.
Said dog is a cocker spaniel and was about three (3) years old.
On or about July 20th and 21st, 1998, the defendants, and each of them,
negligently and carelessly treated and cared for the plaintiff's dog;
negligently and carelessly failed to diagnose and treat the dog's condition;
negligently and carelessly examined the plaintiff's dog; negligently and
carelessly performed the services the plaintiff hired and paid them for; and
negligently and carelessly conducted themselves so as to cause the plaintiff's
dog to be rendered blind. At all times relevant hereto, the defendants, and each
of them, knew or should have known that the plaintiff would be and was a direct
victim of their negligence and carelessness and would suffer severe and
substantial mental distress, mental suffering, injuries and damages as a result
of the said negligence and carelessness.
As a direct and legal result of the conduct of the defendants, and each of
them, the plaintiff's dog was rendered blind and the plaintiff suffered general
damages, medical expenses, property damage, loss of use and affection, wage loss
and other damages.
